NuStar Energy LP has sued oil trader Glencore PLC, blaming it for the alleged damage suffered by a ship that NuStar delivered fuel to, saying in a federal lawsuit that it bought the contaminated fuel from Glencore.
NuStar was sued last month by ship operator Centurion Bulk Pte Ltd, which claims that one of its ships was damaged by fuel NuStar sold that contained compounds not normally found in marine fuel.
NuStar sued Glencore, saying the glencore processed the fuel. "NuStar does not manufacture, formulate, blend, modify or alter the bunker fuel in any way," according to the lawsuit. "The bunker fuel was provided to the ship in the same condition as NuStar received it from Glencore."
Centurion's ship had to stop for repairs following engine failures off the coast of Panama and later in the Pacific Ocean, according to an email attached to the lawsuit. Tests performed on the fuel showed traces of compounds like bisphenol A, or BPA, which is used to manufacture plastics and not petroleum products, according to Centurion.
"Fuels contaminated with uncharacteristic components can cause varying degrees of operational problems, which may range from unusual rate of sludge formation at the filters and purifiers to the wear or damage of the fuel injectors and cylinder components," according to a lab report attached to the lawsuit.
